H0035 (Mental Health Partial Hospitalization Program, per diem) is the most audit-prone PHP code. CMS requires strict 5-hour minimum daily documentation. Miss a single minute of documented service and payer denies the whole day.
The 5-Hour Rule
CMS defines PHP as at least 5 hours per day of active therapeutic programming for 5 days per week (Medicare rule; commercial payers largely mirror). Documentation must show:
- Actual clinical service time per modality (group, individual, family, medication management)
- Non-billable break/meal time excluded from the 5-hour count
- Time-stamp records signed by delivering clinician
